Terms of Service

Acceptance of Terms

By requesting a quote, signing a service proposal, or otherwise engaging with ADP, you accept these Terms and any additional terms outlined in your signed service agreement. If you do not agree to these Terms, do not use our services.

Description of Services

ADP provides property maintenance services including lawn maintenance, lawn care programs, landscape enhancements, hardscaping, and solar field services. Specific services, scope, and frequency are described in each customer's individual service proposal.

We reserve the right to modify, suspend, or discontinue any service at any time, with reasonable notice to active customers.

Quotes & Pricing

Quotes provided by ADP are based on the information shared at the time of estimate and remain valid for thirty (30) days unless otherwise noted. Pricing may be subject to change based on:

• Significant changes to property condition or scope
• Additional services requested after the quote
• Seasonal pricing adjustments communicated in advance
• Material cost fluctuations for project-based work

Final pricing is documented in your signed service proposal or agreement.

Scheduling & Service

Recurring services are scheduled on dedicated route days. Service days may shift due to weather, equipment issues, or other operational factors. We will communicate any changes through our customer portal, email, or phone.

ADP is not responsible for delays caused by inclement weather, natural disasters, property access issues, or other circumstances outside our reasonable control.

Payment Terms

Invoices are issued after each service visit or per the schedule outlined in your service agreement. Payment is due within fifteen (15) days of invoice date unless otherwise agreed in writing.

• Accepted payment methods: credit/debit card, ACH, check, and online payment via Jobber
• Late payments may incur a fee of 1.5% per month on outstanding balances
• Accounts more than 30 days past due may be paused or terminated
• Returned check fees may apply per applicable state law

Cancellation

Recurring service agreements may be cancelled with written notice. Specific cancellation terms, including any minimum service periods or seasonal commitments, are outlined in your service agreement.

One-time projects (installations, landscape enhancements, hardscaping) follow the cancellation policy stated in the signed project proposal, which may include non-refundable deposits for ordered materials.

Limitation of Liability

ADP carries appropriate insurance for the services we provide. Our liability for any claim arising from our services is limited to the amount paid for the specific service in question.

We are not liable for:

• Pre-existing property conditions or damage
• Damage to unmarked underground utilities, irrigation lines, or hidden objects
• Damage to items left in service areas (toys, pet equipment, decorations)
• Indirect, consequential, or punitive damages

Warranty Disclaimer

We stand behind the quality of our work and will address legitimate concerns about service delivery promptly. However, services are provided "as is" without express or implied warranties beyond what is required by law.

Specific warranties on landscape installations, hardscape work, or plant materials are outlined in individual project proposals.

Governing Law

These Terms are governed by the laws of the State of New York. Any disputes arising from these Terms or our services will be resolved in courts located in Monroe County, New York.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
